Epson Authorised Repairer Terms of Use
 
INTRODUCTION
Listed below is an additional set of Terms of Use for Epson Authorised Repairers ("Buyer") covering the on-line lodgment of Epson Warranty Repair Jobs and the ordering of main units and spare parts ("Products"). This Site is owned and operated by Epson New Zealand Limited, Level 4, 245 Hobson Street, Auckland, New Zealand ("ENZ").
 
By using this Site, you agree to the following terms and conditions of use ("Authorised Repairer Terms of Use").
 
If you do not accept the Authorised Repairer Terms of Use, you must not use the Site to lodge warranty repair jobs or to order Products.
 
In addition to the Authorised Repairer Terms of Use, the site has a general set of Channel Epson Terms of Use.

These terms represent the complete Agreement between ENZ and the Buyer for the purchase of Products from the Site. Except for terms implied by applicable legislation, ENZ does not offer or agree to any other conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products. The Buyer's completion of the Order form on the Site will constitute an offer by the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by ENZ.

WARRANTY JOB PROCESSING

You agree that:
  • You will only lodge genuine Epson Warranty jobs in accordance with the terms and conditions of your Epson Authorised Service Agreement;
  • You will not use this Site to collect or store personal information about other Site users;
  • You will not try to gain unauthorised access to any part of the Site or to upload any virus, data or information that may corrupt or affect adversely the operation of the Site;
  • You will not use the Site for any purpose that is unlawful or prohibited by these Terms of Use;
  • That as registered members of this site leave your employment, you will remove that person's account so that person can no longer access the site.
PRODUCT ORDERS

PRICES
The prices to be paid by the Buyer for all Products will be ENZ's current selling price on the date of receipt by ENZ of the Order. All Orders will attract a delivery charge as set out on the Delivery Charges page of the Checkout.

ENZ will not be responsible for errors in pricing that appear on the Site. ENZ will notify a Buyer of a pricing error on the Site before an Order is delivered and the Buyer will have the opportunity to cancel its Order within a reasonable time.

ENZ reserves the right to change its prices from time to time without prior notice to the Buyer. All prices in this website include New Zealand Goods and Services Tax (GST) at the current rate. Please note that on the 1st of October 2010 the New Zealand GST Rate will increase to 15%, all transactions invoiced on or after this date will attract the new rate.

The GST payable by the Buyer will be shown on the invoice, which ENZ will send to the Buyer. Delivery charges to the nominated address will be advised to the Buyer on the delivery screen and Order confirmation pages of the Site.

STOCK AVAILABILITY
If the Buyer orders a Product that is "out of stock", ENZ will order the item and dispatch it to the Buyer as soon as it becomes available. ENZ may make partial shipment of Orders and will ship back-ordered parts separately without additional freight charges.

ORDER DELIVERY AND CANCELLATION
All Orders must be placed via the forms provided on this Site and must specify all information requested, including the quantity and description of Products.

The Buyer must complete all information requested on the Order form before it is processed by ENZ.

ENZ will automatically send the Buyer an e-mail confirming the receipt of the order as soon as possible after the Buyer places an Order. If ENZ does not for any reason accept the Buyer's Order, it will promptly inform the Buyer by email or phone.

ENZ will not be required to accept or process an Order if it has placed the buyers account on "credit hold" or "collection basis".

DELIVERY
Subject to stock availability, delivery of an Order will occur between 2-6 business days after acceptance. ENZ will arrange delivery of all Products to the Customer using its nominated freight carriers. A Buyer cannot collect or arrange collection of Orders from Epson in person or by an alternative courier.

The Buyer acknowledges that, from time to time, ENZ may be subject to production, delivery or other unforeseen delays and that ENZ may allocate distribution of Products among different Buyers at its sole discretion.

All orders less than $200 will attract a delivery charge of $10.00 ex GST. Goods not available for shipment will be shipped at a later date free of charge.

Collection of orders from Epson, either in-person or via alternative courier methods is not available.

If Buyer's Order has not been delivered within a reasonable time, the Buyer should contact ENZ by e-mail click here.

If no one is available at the Buyer's nominated delivery address to receive the Products, ENZ's delivery agent will leave an "unable to deliver" card at that address and the Buyer should follow the directions on that card to obtain delivery of the Products.

PAYMENT
Buyer will make payment for Products purchased from ENZ via its account with ENZ.

On the Checkout page of the Site, a Buyer must confirm its intention to place the Order on its account by pressing the "Order Now" button on the Checkout Shopping Summary webpage.

ENZ reserves the right to exercise its lawful remedies, including the right to delay or cancel delivery of an Order, if a dispute arises over payment.

ENZ may also set off and deduct from any refund due to the Buyer all sums owed by the Buyer to ENZ on any account. If the Buyer's account is placed in collection, ENZ will be entitled to claim all reasonable collection expenses, including full legal fees.

CANCELLING AN ORDER
If a Buyer wishes to cancel an Order prior to shipment, it must contact ENZ Customer Service immediately on (09) 366 6855 or by e-mail click here.

If an Order has been shipped prior to notice of cancellation, ENZ's normal returns and exchanges procedure will apply.

DEAD ON ARRIVAL (DOA)
Epson's Dead on Arrival ("DOA") Policy means either that:-

1) Product has been sold to you and within fourteen (14) days of purchase is found to fail or malfunction during pre-delivery testing or run-up procedures; OR
2) Product is sold to your end-user and fails or malfunctions within fourteen (14) days from that date of purchase.

If the failure or malfunction occurs outside the fourteen (14) day period, the Product is not covered by Epson's DOA Policy and the usual   Epson End User Warranty Policy   should be followed.

You are responsible for determining whether a Product is faulty due to either the general condition of the Product or any malfunction occurring within the initial fourteen (14) day period.

To lodge a DOA request you must first confirm that the Product is DOA. Please call Epson's Customer Call Centre on 0800 23 77 66 to notify the failure/malfunction or contact your nearest Authorised Service Centre. For more information on the Epson Warranty Replacement Process click here.

Once the Product is confirmed DOA by a service centre, who will in turn organise for the Product to be replaced or repaired.

When lodging a DOA request with your an Authorised service centre, you must include:

  • Customer Proof of Purchase together with the faulty product
The Product must be returned in its original packaging and with all its original components (cables, manuals, etc) The following Products are not covered by DOA Policy:
  • All laser printers except EPL-6200(L)
  • All projectors except (EMP-TW20, EMP-TW600, EMP-TWD1, EMP-S3, EMP-S3L)
  • All EXPRESSION scanners
INCORRECT ORDERING OF CONSUMABLES
If the Buyer incorrectly orders a Consumable, it may be returned to ENZ within 7 days of receipt, provided that it is in new condition with its original packaging unopened. Once ENZ receives the original Consumable, it will issue a credit to the Buyer's account.

Before returning an incorrectly ordered Consumable, the Buyer must obtain from ENZ a Return Material Authorization (RMA) Number and return instructions. At its own cost, the Buyer must return the Consumable to ENZ within seven (7) days after receiving the RMA Number. For this clause, the expression "Consumable" includes ink, cartridges, toner, laser components.

INCORRECT SUPPLY OF ORDER
If due to a warehouse or other error on the part of ENZ, the Buyer receives a Product that does not conform to its Order, the Buyer must contact ENZ within 7 days of receipt. If the Product is returned to ENZ in new condition with its original packaging unopened, ENZ will issue a credit to the Buyer's account.

Before returning an incorrectly ordered Product, the Buyer must obtain from ENZ a Return Material Authorization (RMA) Number and return instructions.

PRODUCTS DAMAGED IN TRANSIT
Claims for alleged damage caused to Products in transit from ENZ to the address specified by the Buyer must be notified to ENZ within 48 hours of delivery and the consignment note must be marked by Epson's courier as "Received Damaged".

The Buyer must contact the ENZ Website Administrator click here. and obtain a Return Material Authorisation (RMA) Number and return instructions. In case of Product damage in transit, the Buyer must also supply a copy of the consignment note to ENZ.

DELIVERY OUTSIDE NEW ZEALAND
ENZ will only accept Product Orders from Buyers resident or carrying on business in New Zealand.

AMENDMENT OF TERMS AND CONDITIONS
ENZ may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselves with any such revisions.

SPARE PARTS WARRANTY

ENZ warrants genuine Epson Spare Parts purchased from it against defects in materials and workmanship for a period of 90 days from whichever is the later of either the date of original sale or the date of first use by the Repairer, Dealer or Agent ("Spare Parts Warranty").


The Spare Parts Warranty applies in addition to other statutory warranties expressed or implied by the Consumer Guarantees Act and to Spare Parts used for warranty repairs on Main Units.

The Spare Parts Warranty does not apply to any malfunction or failure arising from:
  1. Neglect, accident or misuse of a Main Unit;
  2. Improper or unauthorized repair or modification of a Main Unit;
  3. Use of other non genuine Epson replacement parts or accessories in a Main Unit;
  4. Improper voltage applied to a Main Unit in which the Spare Parts are installed; or
  5. Use of non-genuine Consumables in a Main Unit.
Epson New Zealand Limited will not have any other liability arising from the use of genuine Epson Spare Parts, including (without limitation) any liability for
  1. Negligence;
  2. Incidental, consequential, indirect or special damage,
  3. Loss of actual or anticipated revenue; or
  4. Loss or corruption of data.
In this warranty, "Main Unit" means any Epson printer, scanner, multifunction printer or projector and "Consumable" includes ink, cartridges and/or paper.

NEW MAIN UNIT WARRANTY
Epson New Zealand warrants that new Main Unit Products will be free from defects in materials or workmanship for a period of one (1) year and two (2) years on Projectors and certain AcuLaser Printers.
